This appeal arises from a denial of a habeas corpus motion. The facts underlying the motion are uncontroverted. Appellant was arrested on July 8, 1974 and charged with having committed assault, kidnapping, and rape on January 18, 1974. Shortly after his arrest and sometime in July of 1974, petitioner was tried in the Butler County Court and found guilty of assault, a misdemeanor charge, and sentenced to sixty days confinement. The county court also held a preliminary hearing on the charge of rape and kidnapping.In both instances probable cause was found, and petitioner was bound over to the grand jury. An indictment was returned and in May of 1975, the jury found petitioner guilty of kidnapping and rape arising out of the January 18, 1974 incident. Appeals were taken to the Ohio court and in the proceeding in the Ohio Court of Appeals, the court stated:
