Description
In this diversity case, defendants Denzil and Roberta Robbins, husband and wife, appeal the district courts judgment in favor of plaintiff Setco Enterprises Corporation (Setco). After a bench trial, the district court found Denzil Robbins liable for fraudulent inducement and fraudulent transfer of property, and found Roberta Robbins liable for fraudulent transfer of property. On appeal, the Robbins argue that the district court erred in denying their motion to dismiss for improper venue and in finding that Setco was the real party in interest. Roberta Robbins also asserts that there was insufficient evidence to sustain her liability for fraud. We affirm in part and remand in part.
